Other Processes

We provide other dispute resolution processes such as conciliation, facilitation, mini-trials and expert appraisals. Contact us for further information.

Conciliation is a process where the independent third party has the power to make non-binding recommendations on how the dispute should be resolved.

Facilitation is where the independent third person co-ordinates and chairs a structured negotiation session. We have used this process to help resolve multi-million dollar construction disputes.

Mini-trials are a structured negotiation process usually involving 2-3 days of chief executive time. We have found this process very effective to resolve large commercial disputes. A team representing each side presents an expedited discussion of the issues to chief executives from each party who then negotiate a settlement.

Expert appraisal is where an independent technical expert gives an opinion on questions put to that person.

Court annexed mediation is now a reality is South Africa.
